Is Your Cherry Hill Home in Probate? Here are Some Solutions for You!

by | Nov 30, 2021

Before we die, it’s ideal to have all of our assets secured to give our loved ones less to worry about. Once we have passed, our assets can easily be turned over to our beneficiaries through a process called probate.

But what happens if the beneficiary has no need for the house and would have better use for the money it can bring. Is it then possible to sell a house in probate in New Jersey? The answer is yes.

Here are some things you should know about selling a house in probate.

The probate law in New Jersey

While all properties that are stipulated in last wills and testaments go through probate, there is no law that forces the beneficiary to keep it.

Selling a house in probate is possible provided the heirs follow the right steps.

The probate process

An Executor of a Will must wait a minimum of 10 days from the death of the decedent before they can probate a Will. Probate must be done in front of the Surrogate in the County of the decedent’s residence at the time of their demise. You can check the death certificate in order to determine which Surrogate’s Court to go to.

Make sure the Will you are reading is the original Will and not a copy of it. Probates only allow original Wills to be reviewed by the Surrogate’s Court.

Once the Will has been verified as authentic, check to see who the named Executor is in the Will and whether or not they qualify.

If the Will you are holding is not self-proved, a witness needs to be located in order to execute a Proof of Witness.

Once the property has been turned over to the beneficiary, they will need to assess it, check for valuables, and have the property valued.

The entire probate process can be lengthy and taxing, both mentally and emotionally. When you’re dealing with the death of a loved one, the last thing you want to worry about is court proceedings and home upgrades.

If you’re the beneficiary and you find that you don’t need another property, selling the property takes quite a bit of an effort especially if the home is worse for wear. You’ll have to tidy up the gardens, repair any leaking roofs, and repaint the entire home.
